Tough to lose a case when it seems Werner really didn't do anything to be at fault for IMO. :(

Wow that seems really terrible. Is there any other recourse for Werner? I don't see how Werner's at fault, going below the speed limit and the pickup was the one that spun out. Can't they appeal or something?

This and the latest lawsuit against another big fleet and the drivers that were stopped in an EMERGENCY lane with their 4 ways on, that got rear ended for no apparent reason, just show how ridiculous this is getting. It's almost scary now even going out on the road.

There is this new trend that even when not at fault, truckers are at fault and the motoring public has no legal responsibility in their own actions.

How is it that the courts  always rule that the "truck driver should have known better" yet the person in a car that hit them and was found at fault didn't have to know better?

 Because truck drivers go to a special school that teaches them everything there is to know about being professional drivers and they are held to a higher standard than the average goof in a 4 wheeler.

"Three weeks ago I couldn't spell truck driver, now I are one!"
